What is an association?
According to art. 44 of the New Civil Code ( Law 10.406 ), associations are considered legal entities under private law, non-profit . The creation of an association is characterized by the union of two or more individuals or legal entities, seeking resources for the promotion of social assistance, defense of class, cultural, philanthropic, political or economic representation interests of a given group.

According to Law 10,406 of 2002, the concept of association is defined as:

“a legal entity under private law whose objective is to carry bc data out cultural, social, religious, recreational activities, etc., without profit, that is, it does not seek profit and has a personality distinct from its members. With the acquisition of legal personality, the association will become subject to rights and obligations. (…)”



Learn about the types of association
As we have seen, the purpose of associations is only to obtain resources for the benefit of a community . Therefore, to be registered as an association it needs to fall within this segment (non-profit).

However, nothing prevents an association from developing economic activities with the aim of raising funds for its social cause. That is, as long as there is no profit remuneration for its directors or its associated members .

For better understanding and definition of their legal nature, associations can be divided into the following categories, such as:

professional associations (business or professional institutions that represent the interests of a professional and/or business community);
cultural, social and sports associations (we can define them as entities linked to artistic themes or that have educational objectives);
philanthropic associations (they seek to offer social assistance to children, the elderly and needy people through volunteer work);
consumer association (aimed at protecting the rights and interests of consumers in general and their members in particular);
parent-teacher association (entities that aim to obtain better teaching conditions and integration of the school with the community);
association of rural producers (its objective is to integrate the actions of farmers to benefit the improvement of productive activities and the community to which they belong).
